The Resolver - online mediation


Welcome to the mediation service of Graham Ross, an English lawyer, retired from general practice, who now uses his 30 years of legal experience together with skills as a fully accredited mediator to help people resolve their disputes outside of the courts or tribunals. Graham is also the founder of The Mediation Room - a leading provider of Online Dispute Resolution (ODR) - and is a member of the United Nations Expert Panel on ODR. The Resolver uses bespoke software to enable the mediation process to be conducted wholly or partially online.

Litigation costs money, wastes your time, causes stress and ruins business and personal relationships with your customers, suppliers, employees and business partners...and that's when you have a good case! It's not just the cost of the legal fees you incur, but the cost of your time diverted from doing what you are best at, advancing your business. Even if you win, you often lose. For example, if a long standing customer takes issue and refuses to pay, you may win in court but you will likely lose all future business from that customer and, of course, how often do people win the judgment at their own cost and then still fail to recover the sum due. Always mediate BEFORE you litigate. Even if you fail, you will make better decisions in the subsequent litigation because of the deeper understanding of your opponent's case gained from the mediation.


What is Mediation?

Mediation is a process whereby a neutral person uses various skills and techniques, including separate and joint confidential discussions with the parties, to both fully understand the position of, and empathise with, each party and to assist them both to 'brainstorm' a solution with which they are both in agreement. It is an entirely voluntary process.

Rather than,as a lawyer, encouraging a client's case to be advanced as strongly as it can, the mediator assists both parties to assess the 'big picture', to consider what is really important about the dispute and to try to help them find compromises and solutions which may be better in the long term than costly conflict.

Why Mediate Online?

Sometimes it is not always possible to mediate in-person.The parties may live in different countries, or otherwise at a distance to each other. One party may be physically disabled to such a degree that travel may be difficult. The amount in dispute may not be sufficient to make the cost of attending an in-person mediation economic.

Even when an in-person mediation is to be undertaken, this online platform can help me better prepare for the mediation, learning fully about each side's position as well as narrowing the issues beforehand and helping all parties to fully understand the best approach to be adopted at the mediation. If settlement is almost, but not, reached in the in-person mediation, this online platform enables me to continue online and thus increases the chances of success.
